Care home nurse who swore at and slapped resident suspended for two years

A care home nurse who swore at a resident and slapped their hand has been suspended for two years.

Chan Chi Keung was a registered nurse at Advinia’s Braemount Care Home in Paisley when the incidents took place on 8 January 2020.

A Nursing and Midwifery Council (NMC) hearing concluded that Chan had told a resident “I warned you about this, you will f****** die tonight,” and slapped her hand away when she was attempting to clean her eye following a fall.

The panel also found Chan had restrained the resident by placing a couch or sofa on one side of her chair with a wall to the other side of the chair as a form of barricade.

The NMC concluded: “The panel was satisfied that in this case, the misconduct was not fundamentally incompatible with remaining on the register. The panel carefully considered the gravity of the concerns brought forward and determined that a suspension with a review is the appropriate course of action.

“Although the incident occurred during a single shift, when looking at the overall context, the panel found that the inappropriate language used towards a vulnerable patient, in conjunction with the act of slapping their hand, cannot be disregarded. The panel’s utmost priority is to ensure the public is suitably protected and was of the view that Mr Chan should address the outstanding concerns before being allowed back into a nursing environment.”

An Advinia spokesperson said: “The safety and wellbeing of our residents is our highest priority and as such we operate a zero-tolerance policy with regard to staff misconduct.

“We can confirm that Mr Chi Keung Chan was dismissed in February 2020 for gross misconduct.”
